Sec. 2: All executive and administrative
officesofficers, agencies and instrumentalities of the executive branch of state government and their respective functions, powers and duties, except for the office of governor and lieutenant governor, the Michigan Department of State Police created pursuant to section 30 of this article, and the governing bodies of institutions of higher education provided for in this constitution, shall be allocated by law among and within not more than 20 principal departments. They shall be grouped as far as practicable according to major purposes.Organization of executive branch; assignment of functions; submission to legislature.
Subsequent to the initial allocation, the governor may make changes in the organization of the executive branch or in the assignment of functions among its units which he considers necessary for efficient administration. Where these changes require the force of law, they shall be set forth in executive orders and submitted to the legislature. Thereafter, the legislature shall have 60 calendar days of a regular session, or a full regular session if of shorter duration, to disapprove each executive order. Unless disapproved in both houses by a resolution concurred in by a majority of the members elected to and serving in each house, each order shall become effective at a date thereafter to be designated by the governor.
Sec. 30: There is hereby created a department of the state government which shall be known and designated as the Michigan Department of State Police which shall consist of a director as its executive head, and of such officers and employees as may be appointed or employed in such department. The director shall be appointed by the governor, by and with the advice and consent of the senate, and shall serve at the pleasure of the governor. The salary of the director shall be such as shall be appropriated by the legislature. The director shall execute a constitutional oath of office. The principal offices of the department shall be in the same county as the seat of government. The ranks of the officers of the department shall be colonel, lieutenant colonel, major, captain, lieutenant, sergeant and trooper. The officers of the department shall have full police powers and duties, in addition to those otherwise granted by law, and shall be primarily assigned to duties of crime prevention, law enforcement and investigation, traffic enforcement and other related police duties. The Michigan Department of State Police shall employ and station said personnel in such a manner as is dictated by the operational and administrative needs of the department in order to effectively discharge the duties and responsibilities of the department.
The legislature may from time to time determine the total number of persons to be employed by the department; provided, however: the total number of enlisted personnel employed by the department shall be, at a minimum, equal to the number of enlisted personnel employed by the department on April 1, 1980. Reductions in the minimum staffing requirements created in this section may only be made when the most recent official census conducted by the state or federal government determines that the population of the state has decreased since April 1, 1980. Any such reduction in force shall not exceed the proportionate decline in the population of the state since April 1, 1980, and shall not apply to any contractual services which may be undertaken by the department after April 1, 1980.
